1. Overview
Welcome to JobPeeks, Inc. ("JobPeeks," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, AI video-generation tools, and related services (collectively, the "Platform").
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use JobPeeks.
2. Who We Are
JobPeeks provides AI-powered tools to help employers transform text-based job descriptions into short-form video job advertisements ("Video Ads").
JobPeeks acts as a technology provider and content host only — not as an employer, recruiter, or employment agency.
3. Definitions
- "Employer" – any company or authorized representative posting jobs or creating Video Ads.
- "Job Seeker" – any individual viewing or engaging with job ads on or via the Platform.
- "User" – any person or entity using the Platform, including Employers and Job Seekers.
- "Content" – any text, images, videos, logos, data, or materials uploaded, generated, or shared on the Platform.
- "AI-Generated Content" – video, audio, or visual content automatically produced by JobPeeks' AI systems based on user-provided inputs.
- "Credits" – prepaid tokens or units that can be redeemed for video ad creation services.
4. Eligibility and Account Responsibilities
To use JobPeeks, you must:
- Be at least 18 years old (or the legal age of majority in your jurisdiction).
- Create an account with accurate and current information.
- Maintain the confidentiality of your login credentials.
- Use the Platform only for lawful purposes and in accordance with these Terms.
You are responsible for all activities under your account.
5. Platform Role and Disclaimer
JobPeeks provides tools for employers to create and distribute job-related video content. We are not an employer, recruiter, or agent of any party, and we do not verify, endorse, or guarantee:
- The accuracy, legality, or truthfulness of any job listing or Video Ad;
- That any job opportunity exists or will result in employment;
- Any outcome of using our Platform.
All information on the Platform is provided "as is" without warranty of any kind.
6. Employer Responsibilities and Representations
Employers represent and warrant that all job-related content (including text and Video Ads):
- Is truthful, accurate, and not misleading regarding pay, benefits, location, duties, or working conditions.
- Complies with all applicable employment, advertising, and consumer-protection laws, including:
- The U.S. Federal Trade Commission Act (15 U.S.C. §45);
- State-level Unfair or Deceptive Acts and Practices (UDAP) statutes; and
- Any Equal Employment Opportunity (EEO) or anti-discrimination regulations.
- Has been reviewed and approved by an authorized company representative prior to publication.
- Does not infringe third-party intellectual property or contain defamatory, discriminatory, or unlawful material.
Employers assume full legal responsibility for the content and claims made in their job ads or Video Ads.
7. AI-Generated Content and Employer Approval
JobPeeks' AI tools generate video and audio content automatically from Employer input. While we strive for quality and accuracy:
- Employers must review and approve all AI-generated content before publishing.
- AI output may include stylistic or interpretive variations; JobPeeks makes no warranties as to accuracy or suitability.
- Employers accept full responsibility for all approved Video Ads.
- JobPeeks disclaims liability for any errors, omissions, or misrepresentations contained in AI-generated content.
8. Content Ownership and Licensing
- Employers retain ownership of their uploaded job descriptions, logos, and approved Video Ads.
- JobPeeks retains ownership of its templates, AI models, avatars, and software.
- By uploading or approving Content, you grant JobPeeks a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, and display that Content as needed to operate the Platform or promote JobPeeks (with your consent).
- You represent that you have all rights necessary to grant this license.
9. Prohibited Uses
You may not use the Platform to:
- Create or distribute false, misleading, or fraudulent job ads;
- Post "ghost jobs" or fake opportunities;
- Impersonate any company or individual;
- Upload content that is defamatory, discriminatory, obscene, or unlawful;
- Infringe third-party intellectual property;
- Attempt to reverse engineer or scrape the Platform; or
- Interfere with Platform security or operation.
10. Moderation and Enforcement
JobPeeks reserves the right to review, refuse, or remove any Content that violates these Terms or applicable law. We may suspend or terminate accounts that engage in deceptive or harmful activity. We are not obligated to monitor all content but may do so to ensure compliance.
11. Credits, Payments, and Refund Policy
(a) Credits and Pricing
Employers may purchase Video Credits and Asset Credits in U.S. dollars (USD). Video Credits are used to generate complete video job ads. Asset Credits are used to generate digital assets (images, audio, video, music, voiceovers) to assist in video creation. Pricing and bundles are listed on our website and may change at any time.
Credits do not expire and are non-transferable.
(b) Refund Policy
JobPeeks strives for fairness and transparency.
- You may request a refund for any unused Video Credits or Asset Credits within 28 days of purchase.
- Credits that have been successfully used to generate videos or assets are not refundable.
- If you used some credits from a package, only the unused portion may be refunded at the pro-rata rate.
- If a generation fails due to a technical error on our platform and the credit was deducted, you may request a refund or credit restoration within 14 days of the failure.
- Refunds are processed manually and issued to the original payment method within 20 business days of approval.
- JobPeeks reserves the right to deny refund requests if there is evidence of abuse, fraud, or excessive refund activity.

(c) Billing Disputes
You agree to contact JobPeeks first at [email protected] or [email protected] before initiating any chargeback or payment dispute. Failure to do so may result in account suspension.
12. Indemnification
You agree to indemnify, defend, and hold harmless JobPeeks, its officers, employees, and affiliates from any claims, damages, or liabilities arising from:
- Your use of the Platform;
- Content (including AI-generated Video Ads) you create, approve, or publish; or
- Any violation of applicable laws, including deceptive advertising or employment statutes.
13. Limitation of Liability
To the fullest extent permitted by law:
- JobPeeks shall not be liable for any indirect, consequential, or punitive damages.
- Our total aggregate liability for any claim shall not exceed the total fees you paid during the six months preceding the event giving rise to the claim.
- The Platform and AI outputs are provided "as is" and "as available," without any warranties of accuracy, fitness, or non-infringement.
14. Privacy and Data Protection
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect personal and business data. By using the Platform, you consent to such processing in accordance with that policy.
15. Compliance with Laws
All Users agree to comply with:
- The Federal Trade Commission Act and Truth in Advertising principles;
- State employment, consumer-protection, and anti-discrimination laws;
- All applicable intellectual-property, data-protection, and export-control laws.
16. Termination
You may close your account at any time by contacting [email protected]. JobPeeks may suspend or terminate your account if you breach these Terms or engage in conduct harmful to the Platform or others.
Unused credits may be refunded in accordance with Section 11(b).
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Wilmington, Delaware, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
You waive any right to participate in a class action or jury trial. Each party will bear its own legal fees unless otherwise ordered by the arbitrator.
18. Changes to These Terms
We may update these Terms periodically. The "Last Updated" date at the top reflects the most recent version. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
